Terms of Service

The contract between you and Atlas Cloud Networks LLC covering accounts, service delivery, payment, suspension, liability and termination.

Effective 1 February 2026. These terms govern your use of services supplied by Atlas Cloud Networks LLC ("RDPForge", "we", "us"), a limited liability company registered in Delaware, United States. By placing an order you accept them.

1. What we supply

We supply self-managed virtual private servers, sold as "Windows RDP" or "Linux VPS" plans, on shared physical hardware operated by us in third-party datacenter facilities. Each instance receives the vCPU, memory, storage, network transfer allowance and IPv4 address stated on your invoice.

Self-managed means we are responsible for the physical hardware, the hypervisor, the network and the availability of the instance. You are responsible for everything inside the operating system: configuration, patching, security, backups of your own data, and anything you install. The optional Managed administration add-on changes this and is described at the point of sale.

2. Accounts and eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is greater. You are responsible for maintaining the confidentiality of your client-area credentials and for all activity conducted through your account and your instances. Two-factor authentication is mandatory on accounts with active services.

Ordering does not require an account, but managing, renewing or reinstalling a service does. Account creation is free.

3. Delivery

Provisioning begins automatically once your payment reaches the confirmation threshold of the network you paid on. Delivery is typically complete within ten minutes. We do not guarantee a specific delivery time, and delayed delivery does not by itself entitle you to a refund outside the money-back guarantee in section 7.

Credentials are sent to the email address supplied at checkout. You are responsible for the accuracy of that address and for the security of that mailbox.

4. Payment

All prices are in United States dollars and are exclusive of any taxes that may apply in your jurisdiction; you are responsible for determining and paying those. We accept cryptocurrency only, processed by OxaPay. Invoices quote a coin amount locked at the prevailing rate for thirty minutes.

Services are prepaid for the term selected. The shortest term we sell is three months; there is no monthly billing option. Renewal is manual: we send reminders 7 days, 3 days and 1 day before expiry and on the due date, but non-renewal is not our responsibility. Underpayments within 2% of the invoiced amount are accepted; overpayments are credited to your account balance.

Upgrades are prorated to the day and invoiced immediately. Downgrades take effect at the next renewal. Customers on a 24-month term keep the price paid for the life of that service, including through renewals, unless the service is cancelled or the specification changed.

5. Suspension and non-payment

An instance is suspended 24 hours after its invoice due date. Data is retained for a further 7 days, during which paying the overdue invoice restores service in full. On day 8 the instance and all data on it are destroyed and the IPv4 address returns to our pool. We cannot recover data after that point.

6. Acceptable use

Your use of our services is subject to the Acceptable Use Policy, which forms part of these terms. Violations may result in immediate suspension or termination without refund. We investigate abuse reports and act on evidence, not on accusation alone, except where the activity is causing active harm to third parties or to our network.

7. Money-back guarantee and refunds

Every customer's first order of a given plan carries a 72-hour money-back guarantee from the time of delivery, refundable in full without justification. Renewals, upgrades, add-ons already provisioned, and services terminated for AUP violations are not refundable. Full details are in the Refund Policy.

Because cryptocurrency payments are irreversible, this guarantee is the contractual replacement for card chargeback rights, and we honour it without argument.

8. Availability and credits

We target 99.9% monthly availability per instance and publish measured uptime and every incident on our status page. Where an instance falls below that threshold in a calendar month, service credits are applied automatically as set out in the SLA. Credits are the sole and exclusive remedy for unavailability.

9. Your data

You retain all rights to the data you place on our infrastructure. We do not inspect, use, sell or disclose the contents of your instances except where compelled by valid legal process in a jurisdiction that binds us, or where necessary to prevent active, demonstrable harm to our network or third parties. Our handling of the limited personal data we do hold is described in the Privacy Policy.

You are responsible for your own backups. Our optional backup add-on is a convenience, not a guarantee, and does not remove your obligation to hold copies of anything you cannot afford to lose.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the services is limited to the amount you paid us for the affected service in the three months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, however caused.

Nothing in these terms excludes liability for fraud, wilful misconduct, or anything that cannot lawfully be excluded.

11. Termination

You may cancel at any time from the client area; the service runs until the end of the paid term and is not refunded pro rata outside the guarantee in section 7. We may terminate for AUP violation, for non-payment, or on 30 days' written notice with a pro-rata refund of any unused prepaid term.

On termination you may export your data at any time during the paid term. After termination, data is destroyed.

12. Changes to these terms

We may amend these terms. Material changes are announced by email to active customers at least 30 days before they take effect, and every prior version is listed above with a summary of what changed. Continuing to use the services after the effective date constitutes acceptance. If you do not accept a material change, you may cancel and receive a pro-rata refund of the unused prepaid term.

13. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of the courts of that state. There is no mandatory arbitration clause; we removed it in version 4.0 because we would rather resolve disputes than make them expensive to bring.
